I'm Still Here AI ("we," "us," "our"), operated by Eleven13 LLC, is committed to protecting the privacy and security of your personal information. This Privacy Policy explains how we collect, use, store, share, and protect your information when you use our digital legacy preservation service at ishai.life (the "Service"). Given the deeply personal and sensitive nature of the data we handle, we hold ourselves to the highest standards of data stewardship.
When you register, we collect your name, email address, phone number, and payment information. Payment information is processed by our third-party payment processor and is not stored on our servers.
We collect video recordings you submit for the purpose of generating your AI avatar and voice model. These recordings contain your visual likeness, voice, facial expressions, and mannerisms.
We collect your responses to our guided AI interview, submitted via text input or speech-to-text transcription. These responses contain personal stories, life experiences, values, advice, beliefs, and personal messages directed to specific family members.
With your explicit consent, we may collect additional personal data including: social media content accessed via OAuth 2.0 authorization (posts, comments, photos, interaction patterns from platforms such as Facebook, Instagram, X/Twitter, and Google); uploaded text message archives; uploaded email correspondence; uploaded photographs, videos, and audio recordings including voicemails; uploaded personal documents including letters, journals, and recipes; and free-text personality descriptions including habitual phrases, nicknames, traditions, and personality markers.
We collect the names, email addresses, relationships, and activation preferences of individuals you designate as Presence Recipients, as well as the individualized private messages you compose for each recipient.
We automatically collect standard technical information including IP addresses, browser type, device information, pages visited, and timestamps for the purpose of maintaining and improving the Service.
We use your information exclusively for the following purposes: to provide, operate, and maintain the Service; to generate your AI avatar and voice model from your video recording; to create your Presence Document from your interview responses and supplemental data; to power conversational AI interactions within the Presence Portal using your captured content as context; to generate life-event-triggered responses based on your captured wisdom and personality; to deliver your Presence to your designated family members upon activation; to deliver scheduled date-triggered messages to your Presence Recipients; to process payments and manage your subscription; to communicate with you about your account and the Service; and to improve and develop the Service.
We recognize that the data we collect is among the most personal and sensitive information a person can share. We implement industry-standard security measures including: encryption of data in transit using TLS/SSL; encryption of data at rest; access controls limiting data access to authorized personnel; secure cloud hosting with reputable infrastructure providers; and regular security reviews.
Despite our efforts, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security but are committed to promptly addressing any security incidents.
We do not sell, rent, or trade your personal information. We share your information only in the following limited circumstances:
With your designated Presence Recipients upon activation, who will receive access to your Presence Portal including your interview content, AI avatar, conversational AI interface, and the individualized messages you composed for them. Each Presence Recipient can only see the private message you wrote specifically for them.
With third-party service providers who assist us in operating the Service, including: cloud hosting providers for data storage; AI service providers for avatar generation, voice cloning, and language model processing; payment processors for billing; and email delivery services for notifications. These providers are contractually required to protect your information and use it only for the services they provide to us.
As required by law, including in response to lawful requests by public authorities for law enforcement or national security purposes.
In connection with a merger, acquisition, or sale of assets, in which case your information would be transferred to the successor entity under the same privacy protections.
You may request a copy of all personal data we hold about you at any time by contacting us at hello@ishai.life. We will provide your data in a commonly used electronic format within 30 days.
You may update or correct your account information, interview responses, family designations, and other personal data at any time through the Service or by contacting us.
You may request the permanent deletion of your account and all associated data at any time by contacting us at hello@ishai.life. Upon receipt of a verified deletion request, we will permanently delete all of Your Content, including your video recordings, interview responses, AI avatar model, voice model, Presence Document, family designation data, and all supplemental personal data, within 30 days. Deletion is irreversible.
You may withdraw your consent for data processing at any time. Withdrawal of consent will result in the deactivation of your Presence and cessation of data processing, but will not affect the lawfulness of processing conducted prior to withdrawal.
You may revoke our access to any connected social media account at any time through the Service or through the settings of the respective social media platform.
We retain your data for as long as your subscription is active. After subscription cancellation, we retain your data for 90 days to allow for reactivation. After 90 days, data is permanently deleted unless an active Presence has been activated for Presence Recipients, in which case the data necessary to maintain the Presence is retained until all Presence Recipients request deletion or the account is otherwise terminated.
The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we learn that we have collected personal information from a child under 18, we will take steps to delete that information promptly.
By using the Service, you acknowledge that you are voluntarily providing us with highly sensitive and personal information, including your physical likeness, voice, life stories, personal beliefs, family relationships, and private messages. You understand that this information will be used to create an AI-powered digital representation of you that your designated family members can interact with. You consent to this processing with full understanding of its nature and scope.
Upon notification of a Presence Creator's passing by the Designated Activator, the data associated with the Presence will be maintained for the benefit of the designated Presence Recipients. Presence Recipients may request deletion of a Presence by contacting us with appropriate verification. We will honor such requests unless doing so would conflict with the documented wishes of the Presence Creator or with applicable law.
The Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the privacy practices of third parties. We encourage you to review the privacy policies of any third-party services you interact with through our Service.
If you are a California resident, you have the right to: know what personal information we collect about you; request deletion of your personal information; opt out of the sale of your personal information (we do not sell personal information); and not be discriminated against for exercising your privacy rights. The Service is operated from the United States. If you are accessing the Service from outside the United States, please be aware that your information will be transferred to, stored, and processed in the United States. By using the Service, you consent to this transfer.
If you provide a mobile phone number, you may receive SMS text messages related to your account and your role on the Service. These messages may include: notifications to a Designated Activator regarding their role and responsibilities; periodic reminders to a Designated Activator; alerts regarding account inactivity status; notifications to Presence Recipients when a Presence becomes available to them; notifications regarding delivery of a Last Letter; and Grief Companion check-in messages to Presence Recipients. These text messages supplement, but do not replace, the equivalent email communications sent for the same purposes.
Message frequency varies depending on your account activity and role on the Service. Message and data rates may apply, depending on your mobile carrier and plan.
You may opt out of SMS messages at any time by replying STOP to any message you receive. You may reply HELP to any message for assistance. After opting out, you will no longer receive SMS messages from the Service, though you will continue to receive equivalent communications via email where applicable.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on the Service and updating the "Effective Date" above. Your continued use of the Service after such changes constitutes acceptance of the updated policy.
