Data Retention Policy

This policy explains how I'm Still Here AI collects, retains, and handles your personal data — including your voice, likeness, stories, and digital Presence — and what happens to that data during your lifetime, after your passing, and in the event of account inactivity.

1. What We Collect

When you create a Presence on I'm Still Here AI, we collect and store the following categories of data:

Biometric data: Your voice recordings (used to create a voice clone) and video recordings (used to create a photorealistic AI avatar). This data is collected only with your explicit written consent, timestamped and recorded at the time of onboarding.

Personal narrative data: Your interview responses, stories, memories, and any written or recorded content you contribute to your Presence.

Contact and identity data: Your name, email address, phone number, and the names and contact details of your designated recipients and Activator.

Optional enrichment data: Social media content you voluntarily import (Facebook, Instagram, etc.) to enhance your Presence.

2. Your Explicit Consent

All biometric data — including your voice clone and AI avatar — is collected only after you provide explicit, informed, written consent. Your consent is timestamped, recorded with your account, and retained permanently as part of your account record. You may not create a Presence without providing this consent.

By providing consent, you authorize Eleven13 LLC to process your biometric data solely for the purpose of creating and maintaining your digital legacy Presence on I'm Still Here AI. Your data is never sold, shared with third parties for commercial purposes, or used for advertising.

3. Data Retention During Your Lifetime

While you are alive and your account is active, all data associated with your Presence is retained indefinitely and updated as you add new content. Your data is encrypted at rest using AES-256 encryption and transmitted via TLS 1.3.

You may delete your account and all associated data at any time by contacting us at eleven13LLC@yahoo.com. Deletion is permanent and irreversible. We will complete deletion within 30 days of your verified request.

4. Account Inactivity

If your account shows no dashboard activity for 45 consecutive days, we will notify your Designated Activator and send you a reminder. This serves two purposes: to check on your wellbeing, and to encourage you to continue building your Presence.

If no response or login activity is received within 14 days of that notice (59 days total), your account will be temporarily frozen. During a freeze, no one — including you and your family — can access the account until it is restored. To restore a frozen account, log in to your dashboard or contact us directly.

5. Data Retention After Your Passing

Your Presence is designed to persist indefinitely after your passing. Upon notification by your Designated Activator, your account transitions to posthumous mode. Your data — including your voice, avatar, stories, and all Presence content — is retained permanently under the terms you established during your lifetime.

I'm Still Here AI acts as a permanent data custodian for your Presence. Your data is never deleted after your passing without an explicit verified request from your Designated Activator or legal next of kin.

If no Activator ever triggers your account — meaning your passing is never formally reported to us — your account remains in its last known state. After 5 years of continuous inactivity with no contact from any associated party, we reserve the right to archive your account. We will make reasonable efforts to contact your Activator before archiving.

6. Recipient Data

Recipients — the family members and loved ones who access your Presence after your passing — have the right to opt out of scheduled outbound messages (birthday messages, grief companion check-ins, memory sparks) at any time using the unsubscribe link included in every outbound message. Opting out stops scheduled messages but does not remove their access to the Presence portal.

7. Biometric Data and State Law

Several U.S. states, including Illinois, Texas, and Washington, have specific laws governing the collection and retention of biometric data. I'm Still Here AI complies with applicable biometric privacy laws by:

— Collecting biometric data only with explicit informed consent
— Storing biometric data securely using industry-standard encryption
— Never selling or profiting from biometric data independent of the platform service
— Providing a clear deletion mechanism upon request

If you are a resident of Illinois, you have specific rights under the Biometric Information Privacy Act (BIPA). Please contact us at eleven13LLC@yahoo.com for information specific to your state.

8. AI Disclosure

I'm Still Here AI creates an artificial intelligence model of you — including a synthesized voice and photorealistic avatar — based on content you provide. Family members who interact with your Presence are interacting with an AI system trained on your data, not with you directly. This disclosure is made explicitly to all recipients before their first portal interaction.

9. Third-Party Services

I'm Still Here AI uses the following third-party services to deliver its platform. Each processes data only as necessary to provide the service:

Supabase — secure database and file storage
Tavus — AI video avatar generation
ElevenLabs — AI voice cloning and synthesis
Anthropic — AI language model for Presence responses
Netlify — platform hosting and serverless functions
Stripe — payment processing
SendGrid — email delivery
Twilio — phone interview system
