Welcome to I'm Still Here AI ("we," "us," "our," or the "Service"), operated by Eleven13 LLC. By accessing or using our website at ishai.life, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
I'm Still Here AI is an AI-powered digital legacy preservation platform. The Service enables individuals ("Presence Creators") to capture their voice, likeness, personality, and wisdom through guided AI interviews and supplemental data, which are then organized into an interactive digital presence ("Presence") accessible to designated family members ("Presence Recipients") through a personalized portal.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding agreement.
To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.
The Service is offered through monthly subscription tiers. By subscribing, you authorize us to charge your payment method on a recurring monthly basis at the rate associated with your selected tier. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refunds are provided at our sole discretion.
You retain ownership of all content you submit to the Service, including video recordings, interview responses, photographs, text messages, social media data, voice recordings, documents, and any other personal materials ("Your Content"). By submitting Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, reproduce, and display Your Content solely for the purpose of providing the Service to you and your designated Presence Recipients.
You represent and warrant that you own or have the necessary rights to all content you submit, and that your content does not infringe upon the rights of any third party.
The Service uses artificial intelligence to generate avatar representations, voice models, conversational responses, and other content based on Your Content. You understand and acknowledge that AI-generated responses are approximations of the Presence Creator's personality and may not perfectly represent what the Presence Creator would have said in any given situation. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content.
As a Presence Creator, you may designate one or more Presence Recipients and select an activation mode (post-mortem, immediate, or date-triggered). You are solely responsible for the accuracy of recipient contact information and the selection of your Designated Activator. Once activated, Presence Recipients will receive access to the Presence Portal and its contents. You may modify your family designations at any time prior to activation.
You may designate a trusted individual ("Designated Activator") authorized to notify the Service when the conditions for Presence activation have been met. By designating an Activator, you authorize us to rely on the Activator's notification to distribute access to Presence Recipients. We are not responsible for verifying the accuracy of the Activator's notification beyond reasonable measures.
You agree not to: use the Service to create a Presence of any individual without their explicit consent; submit content that is unlawful, defamatory, obscene, fraudulent, or harmful; attempt to reverse-engineer, decompile, or disassemble any part of the Service; use the Service for any commercial purpose other than personal legacy preservation; impersonate any person or misrepresent your affiliation with any person or entity; or use automated means to access the Service without our written permission.
We will retain Your Content for as long as your subscription is active and for a reasonable period thereafter to allow for reactivation. You may request deletion of Your Content at any time by contacting us at hello@ishai.life. Upon receipt of a verified deletion request, we will permanently delete Your Content within 30 days, except as required by law.
All aspects of the Service, including its design, technology, software, algorithms, and branding, are owned by us and protected by applicable intellectual property laws. Your Content remains yours. The AI models, interview frameworks, Presence Document structure, and portal technology remain ours.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless I'm Still Here AI, Eleven13 LLC, and its owner, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Clark County, Nevada.
If you provide a mobile phone number in connection with the Service -- whether as a Presence Creator, a Designated Activator, a Presence Recipient, or a contributor -- you consent to receive SMS text messages related to your role on the Service. These messages may include Activator role notifications and reminders, account inactivity alerts, Presence portal access links, Last Letter delivery notifications, Grief Companion check-ins, and other account notifications. Text messages supplement, but do not replace, equivalent email communications sent for the same purposes.
Message frequency varies depending on account activity. Message and data rates may apply, depending on your mobile carrier and plan. You may opt out of SMS messages at any time by replying STOP, and may reply HELP for assistance. No mobile information is shared with third parties or affiliates for marketing or promotional purposes.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Effective Date" above. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will cease immediately. Sections that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitation of liability.
